The legislative basis for the activities of market surveillance in Ukraine:
Market surveillance provides control of the products placed on the market of Ukraine, with the exception of products and services referred to in paragraph five of Article 2 of the Law, in order to prevent the placement on the market of Ukraine products that do not meet the requirements of Ukrainian legislation in the field of technical regulation.
Market Surveillance informs the public about the products for which it was found that they do not meet the requirements of Ukrainian legislation in the field of technical regulation, including those listed in the register of technical regulations of the Ministry of Economy, Trade and Agriculture of Ukraine.
The basic principles, according to which the market surveillance provides its activity and control of products are established by Article 5 of the Law.
Measures, which can be taken by the market surveillance are established by Article 22 of the Law.
Market surveillance in Ukraine is provided by state market surveillance authorities.
State Market Surveillance Authority - a central executive authority, which has its regional offices, implementing the state policy in the field of state market surveillance within the scope of its responsibility, defined in accordance with the Law.
The list of types of products in respect of which the state market surveillance authorities exercise control was approved by the Decree of the Cabinet of Ministers of Ukraine from 28.12.2016 № 1069.
Market Surveillance has the right to check the correctness of the work on conformity assessment directly manufacturer - resident of Ukraine or an authorized representative, if the manufacturer is not a resident of Ukraine.
If this reveals violations of Ukrainian legislation on technical regulation, the market surveillance may impose appropriate sanctions, including financial.
