The management and control of state authorities in the field of procurement is regulated by the Law of Ukraine "On Public Procurement" (hereinafter - the Law).
Public procurement and in general procurement, are public, held for the purpose of acquiring goods and services by one procedure for such procurement. At the same time, bidders are allowed to submit tenders. It is also possible to submit proposals for negotiations, if the procurement is carried out with the use of the negotiation procedure.
In the order established by the Authorized Body, the customer determines the subject matter of the procurement.
According to the Law, bidders are provided with the tender documentation. This documentation describes all the conditions of state or other public procurement. It is developed in compliance with the current legislation of Ukraine and approved by the customer of the products or services, and officially published it on the web portal of the Authorized Body and other authorized electronic resources for free access of potential bidders.
Bidders must provide as part of the tender documentation information and documents confirming compliance with the tender documentation, the requirements established by the customer. The key condition about the products to be purchased is to ensure their placement on the market of Ukraine in full compliance with the legislation of Ukraine, including the Law of Ukraine "On technical regulations and conformity assessment".
The official introduction of products to the market of Ukraine in accordance with the requirements of Ukrainian legislation is mandatory.
For products that fall under the technical regulations procedure for conformity assessment is mandatory and the provision of declarations of conformity and certificates of tender documentation is proof that the introduction of products (goods) to the market of Ukraine comply with the requirements of Ukrainian legislation.
In the case of incorrect performance of works on conformity assessment or their performance not in full, as required by the technical regulations, the participant of the procurement procedure is removed from the bidding.
