The results of conformity assessment of products manufactured at the enterprises of non-residents of Ukraine are recognized only if the provisions of Article 45 of the Law of Ukraine "On Technical Regulations and Conformity Assessment" are fully implemented.
The key criterion that the results of conformity assessment carried out in another country can be recognized in Ukraine is that the conformity assessment procedures in a particular country provide the same or higher level of product safety and the same level of compliance with regulatory documents of this country as the procedures of compliance with technical regulations of Ukraine.
As there are no international treaties between Ukraine and the European Union (most of the technical regulations of Ukraine are harmonized with directives and regulations of the European Union) and between other countries, it is impossible to directly recognize various certificates of these countries.
It is possible only if agreements are concluded between specific certification authorities of other countries and specific certification authorities of Ukraine that are accredited by the National Accreditation Agency of Ukraine (NAAU) and authorized by the Ministry of Economic Development, Trade and Agriculture of Ukraine (Ministry of Economy of Ukraine) under absolute liability of certification authority.
The conformity assessment in the field of electrical and electronic equipment should be highlighted separately, provided that conformity assessment authorities (certification authorities and testing laboratories) are included and operate within CB scheme.
This scheme was created by the International Electrotechnical Commission (IEC) based on international agreements. The certificates of conformity and test reports are mutually recognized by participants of CB system.
It should be noted that there is Mutual Recognition Arrangement between ILAC and NAAU in the scope of “testing and calibration laboratories” under which test reports of ILAC accredited laboratories can be recognized.
